General Booking & Seasonal Letting Terms and Conditions

Gîtes du Château de Malcombe (Bordeaux, Champagne, Burgundy)

1. Purpose

These terms and conditions set out the rules governing the booking and seasonal letting of the self-catering gîtes located at Château de Malcombe, for tourism purposes only. The letting is granted for a fixed term and shall not, under any circumstances, constitute a principal residence.

2. Parties

The Landlord is SAS Château de Malcombe, whose registered office is at Château de Malcombe, 37340 Rillé, France.
The Tenant is the individual or legal entity identified in the booking request and/or the booking confirmation. Subletting or assignment (whether free of charge or for consideration) is strictly prohibited.

3. Accommodation designation and description

The accommodation let is one of the Château de Malcombe gîtes indicated at the time of booking and confirmed in the booking confirmation (Bordeaux, Champagne, or Burgundy), located at Château de Malcombe, 37340 Rillé, France.

Each gîte is an independent furnished tourist accommodation. The description, maximum occupancy, detailed layout (rooms, beds) and facilities are those shown on www.chateaudemalcombe.com, which the Tenant acknowledges having read and accepted.

Outdoor CCTV is installed on the estate. Cameras cover only the shared external areas around the château and are used solely for security of access points and common areas.

4. Term, price, utilities and tourist tax

The rental period and the total price of the stay are those displayed at the time of booking and stated in the booking confirmation sent to the Tenant.

The rental price includes the following utilities: water, gas and electricity, for normal and reasonable use of the accommodation.

The tourist tax is 4.00% of the nightly rate excluding VAT, capped at €3.00 per person per night, plus 10% as the departmental additional tax, in accordance with applicable regulations. The exact amount is calculated under the rules applicable to the stay and corresponds to the amount displayed at the time of booking and/or stated in the booking confirmation.

5. Booking, payment and cancellation

A booking becomes binding once confirmed, thereby constituting acceptance of these terms and conditions.

The booking process, payment schedule and cancellation policy are those displayed at the time of booking and summarised in the booking confirmation (or confirmation of receipt of the booking request) sent to the Tenant.

If payment is not made in accordance with the agreed schedule, the Landlord reserves the right to cancel the booking, without refund of any sums already paid.

If the Landlord cancels the booking for any reason other than a breach of the Tenant’s contractual obligations, the Landlord shall refund the sums already paid by the Tenant as soon as reasonably possible.

6. Security deposit

In accordance with the information provided at the time of booking, a €300 pre-authorization is placed on your bank card prior to arrival and released after departure, provided there is no damage and the accommodation is returned in proper condition.

In the event of damage, charges may be retained up to the amount of the repairs required, supported by evidence/invoices. “Tenant damage” includes, in particular, any deterioration of the accommodation and any damage, loss or theft affecting the furnishings and contents during the rental period.

7. Check-in & check-out

  • Check-in: from 16:00
  • Check-out: no later than 11:00

Check-in and check-out times may be adjusted by prior agreement with the Landlord. Any departure after 11:00 (or after the agreed time) may result in a late check-out fee equal to 50% of one night’s rate.

8. Occupancy and pets

The gîte is let for the maximum number of guests stated at the time of booking.

External visitors are not permitted to access the property or use its facilities (including the swimming pool).

Additional guests may be considered only with the Landlord’s prior agreement and within each gîte’s maximum capacity: Champagne: 6 persons, Bordeaux: 5 persons, Burgundy: 4 persons.

Pets are not permitted. Please note, however, that the owners’ dogs are present on the estate.

9. Included services

The rental price includes: end-of-stay cleaning, bed linen, and bath towels. Towels for outdoor use (pool, etc.) are not provided.

The end-of-stay cleaning fee covers basic cleaning only. The following are not included: cleaning of kitchen appliances and equipment (oven, hob, refrigerator), washing and putting away dishes, emptying bins, and cleaning the plancha/hotplate. Where applicable, an additional cleaning charge of €100 may be applied.

10. Use of the property

The Tenant undertakes to use the accommodation peacefully, to comply with the house rules applicable to the property, to keep it in good condition, and to use utilities and comfort systems (heating, electricity, water, etc.) and equipment (appliances, multimedia, kitchen equipment, etc.) in a normal and reasonable manner.

Smoking is strictly prohibited inside the gîte and cigarette ends must not be discarded outside (lawn, forest, gravel areas).

The Tenant is invited to check the condition of the accommodation and equipment upon arrival. Any issue, damage noticed on arrival, or missing inventory item must be reported to the Landlord within 24 hours of arrival to allow prompt resolution.

The Tenant agrees to inform the Landlord as soon as possible of any breakdown, damage, incident or malfunction.

The Landlord undertakes to inform the Tenant as soon as possible of any change beyond the Landlord’s control that may affect comfort or quiet enjoyment of the property (nuisance, equipment failure, etc.). Where equipment that significantly affects comfort becomes faulty, the Landlord will take reasonable steps to arrange repair or replacement as soon as possible.

11. Keys / access

Keys are handed to the Tenant in person on the day of arrival.
The Tenant shall return the keys in person to the Landlord on the day of departure.

The Tenant is prohibited from making copies of the keys or any access device provided by the Landlord.

In the event of loss, breakage or failure to return a key (or any access device), the Tenant may be charged for replacement costs, travel/attendance costs and, where applicable, locksmith intervention, supported by evidence/invoices.

12. Liability and insurance

The Tenant is responsible for any damage or accident occurring during the stay, both inside and outside the gîte. The Tenant declares that they hold valid holiday-let/public liability insurance (or equivalent civil liability cover) for the duration of the stay.

The Landlord accepts no liability for loss, theft or damage to the Tenant’s personal belongings.

The Landlord and/or estate staff may access the gîte for inspection or technical intervention purposes, having informed the Tenant in advance.

13. Termination

In the event the Tenant fails to comply with any contractual obligation, this agreement shall be terminated automatically by operation of law. Termination shall take effect 48 hours after a formal notice served by registered letter or delivered by hand has remained without effect.

14. Governing law and disputes

This contract is governed by French law. In the event of a dispute, the courts within the jurisdiction of the Landlord’s domicile/registered office shall have exclusive competence.

15. Acceptance

Confirming the booking constitutes full and unconditional acceptance of these Terms and Conditions and the House Rules, available via the following link: House Rules
